§ 1 Preliminary provisions

2. These regulations are both for Consumers as well as Entrepreneurs making use of the Shop and define the principles of using the Online Shop as well as principles and procedures of concluding remote Sales Contracts with Customers via the Online Shop.

 

§ 2 Definitions

  1. Consumer – a natural person concluding a contract with the Seller within the Shop, subject of which is not directly related with that person’s business or professional activities.

  2. Seller - a natural person running business under the name Firma Bolecki, registered in the CEIDG (Central Registration and Information on Business) kept by a Ministry appropriate for the economy, NIP (Tax ID No.) 549-212-12-25, REGON (Business Registration No.) 120398573.

  3. Customer – general concept defining each entity making purchase via the Online Shop.

  4. Domestic Customer – each entity making purchase via the Online shop from territory of Poland.

  5. Foreign Customer – each entity making purchase via the Online shop, where the Order is to be delivered abroad Poland, or is paid with foreign money transfer or in PayPal system.

  6. Entrepreneur – a natural person, a legal person or organization unit not being a legal person, with legal capacities granted by separate laws, running economic activities on its own behalf, making use of the Shop.

  7. Shop – Online Shop run by the Seller under bolecki.pl website address.

  8. Remote Contract – a contract concluded with the Customer within an organized system of contract conclusion in the distance (within the Shop), without simultaneous physical presence of the parties, with exclusive use of one or more methods of remote communication until the moment of contract conclusion inclusive.

  9. Regulations – these Shop regulations.

  10. Order – declaration of intent of the Customer placed by means of an Order Form and aimed directly at concluding the Product or Products Sales Contract with the Seller.

  11. Account – Customer’s account in the Shop, where data provided by the Customer as well as information concerning Orders placed by him/her in the Shop are collected.

  12. Registration Form – a form available in the Shop, making possible to create an Account.

  13. Order Form – an interactive form available in the Shop making possible to place the Order, especially by adding Products to the Basket and specifying the Sales Contract terms, including delivery and payment method.

  14. Basket – element of the Shop software, where Products selected by the Customer for purchase are visible, and also where it is possible to define and modify the Order data, especially quantity of the Products.

  15. Product – a movable/service available in the Shop, being a subject of the Sales Contract between the Customer and the Seller.

  16. Sales Contract – a contract for selling the Product, concluded or being concluded between the Customer and the Seller via the Online Shop. Service contract and specific-task contract – according to the Product’s feature - is also a Sales Contract.

§ 3 Contact with the Shop

  5. A Customer may contact the Seller under addresses and telephone numbers given in this paragraph.

  6. A Customer may communicate with the Seller by telephone within 8:00 – 18:00, on working days from Monday to Friday.

§ 4 General information

  1. The Seller is not responsible, within the widest extent allowable by the laws, for disturbances including interruptions of the Shop operation.

  2. Reviewing the Shop’s assortment does not require to establish an Account.

  3. Prices given in the Shop are gross prices (including VAT) expressed in PLN.

§ 5 Establishing an Account in the Shop

  1. To establish an Account in the Shop, fill out the Registration Form. It is necessary to provide the data indicated as obligatory, which enable to deliver the goods ordered.

  2. Establishing an Account in the Shop is free of charge.

  3. Logging in the Account is done by entering the login and the password established in the Registration Form.

  4. At any time, without giving any reason or incurring any costs, the Customer may cancel the Account, by sending appropriate request the Seller, in particular by e-mail.

§ 6 Principles of placing an Order

  1. Orders may be placed by natural persons of age, legal persons, organization units without legal personality.

  2. Orders may be placed at the Shop bolecki.pl, adding Products to the Basket and proceeding in accordance with information on the Shop’s website.

  3. Orders may be placed without the necessity to have an Account, however to execute the Order it is necessary to provide all the indispensable and true data.

  4. Orders may be placed by phone under the number +48 503-064-713. These are being received as far as possible nn working days (Monday – Friday) within (9:00 – 14:00.

§ 7 Delivery and payment methods offered

  1. A Customer may use one of the following payment methods:

    1. cash on delivery

    2. prepayment to the Seller’s account.

  2. Delivery

    1. shipment ordered within the territory of Poland is executed by DPD or UPS or InPost parcel locker. Shipment cost depends on the payment method:

      • 10 PLN in case of prepayments and shipment by the InPost parcel locker;

      • 17 PLN in case of prepayment and shipment by the DPD /UPS;

      • 24 PLN in case of cash on delivery and shipment by the DPD/UPS.

    2. a Customer may select any shipment method, however the Shop is not obliged to use the carrier indicated by the Customer.

    3. self-pickup is free of charge, however possible after previous agreement.

 

  1. Foreign Customers:

    1. it is not possible to order cash on delivery;

    2. cost of shipment abroad Poland is to be agreed individually depending on the country and postal code of the destination. This cost should be assessed by the Foreign Customer with the Shop before placing the Order;

    3. prepayments (transfers to the Account or PayPal) are obligatory, no cash on delivery;

    4. the target payment currency is PLN (if not agreed otherwise before the Order). The Foreign Customer is also obliged to cover all the costs related with the payment (e.g. bank or PayPal system provisions).

§ 8 Execution of the Sales Contract

  1. Conclusion of the Sales Contract between a Customer and the Seller ensues after placing Order by the Customer in accordance with § 7 of the Regulations, and after its confirmation by the Shop.

  2. After placing the Order, the Seller immediately confirms its receiving and simultaneously accepts it for execution. Confirmation of the Order receiving and its acceptance for execution is done by sending appropriate message by e-mail from the Seller to the Customer to his/her e-mail address provided during placing the Order. This confirmation includes at least the Seller’s declaration on receiving the Order and its acceptance for execution and confirmation of the Contract conclusion. At the moment the Customer receives this e-mail message, the Sales Contract between the Customer and the Seller is concluded.

  3. If the Customer selects:

    1. payment by money transfer, electronic payment or credit card he/she is obliged to make the payment within two calendar days from the date of the Contract conclusion – otherwise the Order is canceled.

    2. payment by cash on delivery, he/she is obliged to make payment when receiving the shipment.

    3. self-pickup, he/she is obliged to make payment when picking up the goods ordered.

  4. The Product delivery time to the Customer, i.e. transferring it to the carrier or preparing it for self-pickup – if not specified otherwise at the Product’s website – is 72 hours, which counts as follows:

    1. if prepayment is selected – from the date of crediting the Seller’s account or from the next day if crediting was done after twelve o’clock.

    2. if cash on delivery or self-pickup is selected – from the date of the Contract conclusion or from the next day if the Order was accepted after twelve o’clock.

  5. If Products with various delivery times are ordered, the delivery time is the longest specified time. The Customer has possibility to request partial Products delivery covering consecutive delivery costs or delivering all Products together after completing the whole Order.

  6. If the Product is not available, the Customer is informed about it and about the new delivery time immediately. In such case, the Customer may give up the Order, wait for completing the whole Order or purchase only the elements available at that time.

  7. When ordering Products with different readiness for picking up, the Customer may pick up the Products partially (according to their readiness) or pick up all the Products together after completing the whole Order.

  8. Products delivery is performed only within the territory of Poland, unless the parties agree otherwise before placing the Order.

§ 9 The rights to withdraw from a Contract

  1. A Consumer may withdraw from a Sales Contract within 14 days, without giving any reason. He/she has 14 days to return the Product.

  2. The time specified in point 1, starts running from the date of delivering the Product to the Consumer or a person specified by him/her different then the carrier.

  3. In case of a Contract covering many Products delivered separately in batches or parts, the time specified in point 1 starts running from the delivery of the last thing, batch or part.

  4. A Consumer may withdraw from the Contract making a statement about withdrawal from the Contract. To meet the deadline of withdrawal from a Contract it is sufficient to send the statement before this deadline.

  5. The statement may be sent by post or e-mail to the Seller’s e-mail address or placed at the Seller’s website – contact data of the Seller are given in § 1. The statement may be also placed on a form DOWNLOAD THE FORM, and on the annex to the law of May 30, 2014 on the consumer rights, however it is not obligatory.

  6. The Consumer delivers the goods to the Seller at his/her own cost and risk.

  7. If not agreed otherwise with the Seller, the costs incurred by the Consumer will be refunded within 14 days by the same method as paid to the Seller.

  8. The Seller refunds the cost of the Product purchased and the less expensive shipment cost. Additionally, the amount refunded may be decreased if the Consumer used the thing returned in the way exceeding the one necessary for checking its features.

§ 10 Claims and warranty

  1. Sales contracts cover new Products.

  2. In case of defect of the Product purchased at the Seller, the Customer has rights to claim it by way of warranty or based on the rule of guarantee.

  3. The claim shall be submitted by phone or e-mail, to the Seller’s contact data given in these Regulations.

§ 11 Extrajudicial methods of claims consideration and recovery of claims

  1. Detail information on the possibility to take advantage by the Consumer of the extrajudicial methods of claims consideration and recovery of claims, and the rules of access to these procedures are available at the seats and websites of the district (municipal) consumer ombudsmen, public organizations, which statutory tasks include consumers protection, Provincial Inspectorates of Trade Inspection and at the following website addresses of the Office of Competition and Consumer Protection:

  2. The Consumer has the following, exemplary, possibilities of extrajudicial methods of claim consideration and recovery of claims:

  1. the Consumer is entitled to apply to the permanent consumer court of arbitration, mentioned in art. 37 of the law of December 15, 2000 on the Trade Inspection (Journal of Laws of 2014, item 148 with subsequent modification), to settle a dispute resulting from the Contract concluded with the Seller.

  2. the Consumer is entitled to apply to the Provincial Inspector of Trade Inspection, in accordance with art. 36 of the law of December 15, 2000 on the Trade Inspection (Journal of Laws of 2014, item 148 with subsequent modification), to start mediation proceeding on conciliatory closing of the dispute between the Consumer and the Seller.

  3. the Consumer may obtain free of charge support to settle the dispute between him/her and the Seller, also making use of the free of charge support of the district (municipal) consumer ombudsmen, public organizations, which statutory tasks include consumers protection (between others Consumers Federation, Polish Consumers Association).

§ 12 Personal data in the Online Shop

  1. The Seller administrates Customers’ personal data collected via the Online Shop.

  2. Customers’ personal data collected by the administrator via the Online Shop serve the purpose of Sales Contracts execution, and if the Customer agrees also marketing purposes.

  3. The following may receive the personal data of the Online Shop Customers:

  1. in case of Customers making use of courier shipments as the delivery method, the Administrator makes the Customer personal data available to the selected carrier or agent executing the shipments ordered by the Administrator.

  2. in case of Customers making use of electronic payments or payment cards, the Administrator makes the Customer personal data available to an entity handling the above payments in the Online Shop.

  1. The Customer has rights to access the content of his/her data and to correct them.

  2. Providing the personal data is voluntary, however not providing the personal data indicated in the Regulations, which are necessary for concluding the Sales Contract results in impossibility to conclude such contract.

§ 13 Final provisions

  1. The Seller reserve the rights to modify the Regulations due to important reasons, i.e. changes of the law provisions, changes of the payment and delivery methods – within a scope that such changes influence execution of these Regulations provisions. The Customer expecting execution of his/her order will be advised of such modification at least 7 days in advance.

  2. For matters not regulated by these Regulations, commonly valid Polish laws apply, especially Civil Code, laws on electronically supplied services, laws on consumers rights, laws on personal data protection.

  3. The Customer has rights to take advantage of the extrajudicial methods of claims consideration and recovery of claims. For this purpose he/she may bring a compliant via EU ODR website available under the address: http://ec.europa.eu/consumers/odr/.

Privacy policy of the bolecki.pl service

  1. This Privacy Policy specifies the rules for processing and protection of personal data provided by the Users in relation to making use by them of this service.

  2. The Administrator of personal data incorporated in this service is Firma Bolecki, Bartłomiej Stróżyński seated in 32-650 Kęty, ul. Żwirki i Wigury 24. NIP (Tax ID No.) 549-212-12-25, REGON (Business Registration No.) 120398573.

  3. For the sake of safety of the data entrusted to us, we established internal procedures and recommendation in order to prevent making the data available to unauthorized persons. We monitor their execution and continuously verify their compliance with respective laws – law on personal data protection, law on electronically supplied services, as well as any kind of EU executive and legal acts.

  4. Personal data are processed on the basis of consent expressed by the User and in cases when the law provisions authorize the Administrator to proceed the personal data in accordance with the law provisions or in order to execute the contract concluded between both parties.

  5. This service gathers information about users and their behavior in the following way:

  1. from information entered voluntarily in the forms;

  2. by gathering the “cookies” files;

  3. by watching the movements in the website.

  1. This service collects information voluntarily provided by the user.

  2. Data provided in the form are proceeded in order to fulfill the function of particular form, e.g. in order to effect the service of the information contact.

  3. Personal data left in this service will not be sold nor made available to third parties, in accordance with provision of the Law on personal data protection.

  4. A natural person who enters his/her personal data in the form, has rights to view them. He/she can also modify the data or request to stop their proceeding at any time.

Policy of "cookies" files in the bolecki.pl service

  1. „Cookies” files are meant as information data kept in users’ terminal devices, designed for making use of websites. In particular, these are text files, including the website name from which they derivate, time to be kept at the terminal device and unique number.

  2. This service does not collect automatically any information, except information included in cookies files.

  3. Cookies files are designed for making use of this service websites. The operator uses these files to:

  1. adjust the website content to individual preferences of the user, first of all these files recognize his/her device to display the website in accordance with his/her preferences;

  2. create anonymous statistics excluding the possibility of identifying the user.
